1. Acceptance of the Terms

By creating an account, purchasing a subscription, or otherwise using the Services, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Services.

2. Description of the Service

Retouch Events is a software-as-a-service platform that provides professional photo retouching for events. Photographers and clients upload images, our editing team processes them, and final files are delivered through the platform and/or third-party storage. We offer different subscription plans with features such as color correction, object removal, skin smoothing, and other image editing services.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements.

4. Accounts and Registration

To use the Services you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

5. Subscriptions, Plans, and Payments

We offer monthly and annual subscriptions. Payments are processed securely through our third-party payment providers, Stripe and MercadoPago; we do not store full payment card details. Eligible plans may include a 7-day free trial.

Subscriptions automatically renew at the end of each billing period unless cancelled beforehand. By subscribing, you authorize us and our payment providers to charge the applicable fees and taxes to your selected payment method on a recurring basis until you cancel. Prices may change with prior notice.

6. Cancellation and Refunds

You may cancel your subscription at any time from your account dashboard. Cancellations take effect at the end of the current billing period, and you will retain access until then. Except where required by applicable law, payments are non-refundable and we do not provide refunds or credits for partially used periods.

7. Your Content and License

You retain all ownership rights in the images and content you upload ("Your Content"). You grant us a limited, non-exclusive, worldwide license to host, store, process, edit, and transmit Your Content solely for the purpose of providing the Services to you. We will not use Your Content for any other purpose without your consent. You represent that you have all necessary rights and consents (including any model or third-party releases) for the content you upload.

8. Acceptable Use

You agree not to use the Services to:

• Upload or distribute content that is illegal, infringing, defamatory, obscene, or that violates the rights of others.
• Upload content depicting minors in any inappropriate or unlawful manner.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems.
• Use the Services to transmit malware or engage in fraudulent activity.

9. Intellectual Property

The Services, including all software, design, text, graphics, and trademarks (excluding Your Content), are owned by or licensed to Retouch Events and are protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to access and use the Services in accordance with these Terms.

10. Third-Party Services

The Services rely on third-party providers, including Stripe and MercadoPago (payments) and Dropbox (file storage). Your use of those services may be subject to their own terms and policies. We are not responsible for the acts or omissions of third-party providers.

11. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by law, Retouch Events and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim arising out of or relating to the Services will not exceed the amounts you paid to us in the twelve (12) months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Retouch Events and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, Your Content, or your violation of these Terms.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or if we discontinue the Services. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will survive.

15. Governing Law and Dispute Resolution

Retouch Events operates from Argentina and provides the Services to users in the United States, Latin America, and Argentina. These Terms are governed by the laws of the Argentine Republic, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be submitted to the competent courts of the City of Buenos Aires, Argentina.

Nothing in this section deprives you of the protection afforded by the mandatory consumer-protection laws of your country or state of residence, which continue to apply where required by law.

16. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Services and update the "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
